C/A: 511-6-1.04(7)(c) - Food Labels (Pf, C) (c) Food Labels. 1. Food packaged in a food service establishment, that is not provided by a foodservice employee upon consumer request, shall be labeled as specified in law, including 21 CFR 101- Food labeling, and 9 CFR 317 Labeling, marking devices, and containers. 2. Label information shall include: (i) The common name of the food, or if there is no common name, an adequately descriptive identity statement; (ii) If made from two or more ingredients, a list of ingredients and sub-ingredients in descending order of predominance by weight, including a declaration of artificial color or flavors and chemical preservatives, if contained in the food; (iii) An accurate declaration of the net quantity of contents; (iv) The name and place of business of the manufacturer, packer, or distributor; and (v) The name of the food source for each major food allergen contained in the food unless the food source is already part of the common or usual name of the respective ingredient. Pf (vi) Except as exempted in the Federal Food, Drug, and Cosmetic Act § 403(Q)(3) - (5), nutrition labeling as specified in 21 CFR 101 - Food Labeling and 9 CFR 317 Subpart B Nutrition Labeling. (vii) For any salmonid fish containing canthaxanthin or astaxanthin as a color additive, the labeling of the bulk fish container, including a list of ingredients, displayed on the retail container or by other written means, such as a counter card, that discloses the use of canthaxanthin or astaxanthin. 3. Bulk food that is available for consumer self-dispensing shall be prominently labeled with the following information in plain view of the consumer: (i) The manufacturer's or processor's label that was provided with the food; or (ii) A card, sign, or other method of notification that includes the information specified under paragraphs 2(i), (ii), (v) and (vi) of this subsection. 4. Bulk, unpackaged foods such as bakery products and unpackaged foods that are portioned to consumer specification need not be labeled if: (i) A health, nutrient content, or other claim is not made; (ii) There are no state or local laws requiring labeling; and (iii) The food is manufactured or prepared on the premises of the food service establishment or at another food service establishment or a food processing plant that is owned by the same person and is regulated by the food regulatory agency that has jurisdiction.
Nonfood-contact surfaces clean — Inspector Note: Observed dry storage containers, equipment prep tops and prep top coolers unclean on the outside with debris build up. Corrective Action: 511-6-1.05(7)(a)2,3 - Equipment, Food/Nonfood-Contact Surfaces, and Utensils, food-contact surfaces of cooking equipment & nonfood-contact surfaces free of accumulations (C) 2. The food-contact surfaces of cooking equipment and pans shall be kept free of encrusted grease deposits and other soil accumulations. 3. Nonfood-contact surfaces of equipment shall be kept free of an accumulation of dust, dirt, food residue, and other debris. Advised to have deep cleaned and increase cleaning frequency.
Physical facilities installed, maintained, and clean — Inspector Note: Observed floors behind and under cooking equipment unclean with food debris build up. C/A:511-6-1.07(5)(a),(b) - Good Repair, physical facilities maintained; Cleaning, Frequency & Restrictions, cleaned often enough to keep them clean (C) (5) Maintenance and Operation. (a) Good Repair. All physical facilities shall be maintained in good repair. (b) Cleaning, Frequency and Restrictions. 1. The physical facilities shall be cleaned as often as necessary to keep them clean and by methods that prevent contamination of food products. 2. Except for cleaning that is necessary due to a spill or other accident, cleaning shall be done during periods when the least amount of food is exposed, such as after closing. Advised to have deep cleaned and increase cleaning frequency.
Certified Food Protection Manager — Inspector Note: Observed no CFSM certificate at time of inspection. PIC showed certificate from back wall covered by boxes. CA: 511-6-1.03(3)(c) - Certification Documentation (Pf) 1. The original CFSM certificate shall be posted in public view in each food service establishment. An additional copy shall be retained on file at the food service establishment at all times, and shall be made available for inspection by the Health Authority. COS: CFSM WAS MOVED TO PUBLICE VIEW AND ADVISED PIC CFSM SHALL BE AN EMPLOYEE THAT WORKS ACTIVELY IN MAIN KITCHEN AND CERTIFICATE SHOULD BE PLACED IN PUBLIC VEIW.
Hands clean and properly washed — Inspector Note: Observed employee with gloved hands wash soiled dishes then proceed to handle clean dishes. COS; EMPLOYEE WAS REDIRECTED AND EDUCATED ON WHEN TO WASH. EMPLOYEE COMPLIED PLACED CLEAN DISH AT DISH PIT TO BE REWASHED, REMOVED GLOVES AND WASHED HAND PROPERLY BEFORE RETURNING TO WORK.
Proper eating, tasting, drinking, or tobacco use — Inspector Note: Upon entering main kitchen observed employee drinking from cup without lid or straw standing next to prep top. COS: ADVISED EMPLOYEE OF PROPER EATING AND DRINKING IN MAIN KITCHEN, EMPLOYEE COMPLIED AND CUP WAS DISCARDED AND HANDS WERE WASHED PROPERLY BEFORE RETURNING TO WORK. CA: 511-6-1.03(5)(k)1&2 - Eating, Drinking, or Using Tobacco (C) (k) Hygienic Practices. 1. Employees shall not use any form of tobacco products, or electronic devices that simulate tobacco smoking, while engaged in food preparation or service, nor while in areas used for equipment or utensil washing and storage, food preparation or food storage. Employees shall only use tobacco products or electronic devices that simulate tobacco smoking in approved designated areas. 2. Employees shall consume food only in approved designated areas separate from food preparation and serving areas, equipment or utensil areas and food storage areas. However, drinking from a single service beverage cup with a secure lid and straw that is handled to prevent contamination of the employee’s hands, the container, exposed food, clean equipment, utensils and linens, unwrapped single-service and single-use articles will be allowed.
Food separated and protected — Inspector Note: Observed raw bacon stored directly above shredded cheese and raw ground beef stored directly next to raw chicken in walk in cooler. Observed raw beef steak stored directly next to cooked shrimp and cooked cut chicken and raw cut chicken stored directly above raw fish stored at perp top cooler. COS: RAW FISH, COOKED CUT CHICKEN, COOKED SHRIMP, WERE DISCARDED BY PIC. CA:511-6-1.04(4)(c)1(i)(ii)(iii)(v)(vi)(vii)(viii) - Packaged & Unpackaged Food Separation, Packaging, and Segregation (P, C) (c) Packaged and Unpackaged Food - Separation, Packaging, and Segregation. 1. Food shall be protected from cross contamination by: (i) Except as specified in paragraph (i)(IV) of this subsection, separating raw animal foods during storage, preparation, holding, and display from: (I) Raw ready-to-eat food including other raw animal food such as fish for sushi or molluscan shellfish, or other raw ready-to-eat food such as fruits and vegetables, P and (II) Cooked ready-to-eat food; and P (III) Fruits and vegetables before they are washed; P (IV) Frozen, commercially processed and packaged raw animal food may be stored or displayed with or above frozen, commercially processed and packaged, ready-to-eat food. Food stored covered — Inspector Note: Observed multiple items in reach in freezer and walk in cooler uncovered. COS: ALL ITEMS WERE COVERED BY PIC. CA: 511-6-1.04(4)(c)1(iv) - Packaged & Unpackaged Food, food stored covered(C) (iv) Except as specified under paragraph 2. of this subsection and when cooling as specified in DPH Rule 511-6-1-.04(6)(e)2.(ii), storing the food in packages, covered containers, or wrappings, except for loosely covered or uncovered containers in which food is being cooled if protected from overhead contamination;
Approved thawing methods used — Inspector Note: Observed raw shrimp thawing at 3 compartment sink in standing water. C/A: 511-6-1.04(6)(c) - Thawing (C) (c) Thawing. Except as specified in paragraph 4 of this subsection, time/temperature control for safety food shall be thawed: 1. Under refrigeration that maintains the food temperature at 41°F (5°C) or less; PF or 2. Completely submerged under running water: (i) At a water temperature of 70°F (21°C) or below, PF COS: Running water was turned on to complete proper thawing process.
Contamination prevented during food preparation, storage, display — Inspector Note: Observed raw chicken wings stored directly on floor in walk in cooler. C/A: 511-6-1.04(4)(q) - Food Storage (C) (q) Food Storage. 1. Except as specified in paragraphs 2 and 3 of this subsection, food shall be protected from contamination by storing the food: (iii) At least 6 inches (15 cm) above the floor. COS: Chicken was moved to shelf 6 inches from the floor.
Food and nonfood-contact surfaces cleanable, properly designed, constructed, and used — Inspector Note: Observed prep top cooler not maintaining a TCS food temp of 41F or below. C/A: 511-6-1.05(6)(a) - Good Repair & Proper Adjustment (C) (6) Maintenance and Operation. (a) Good Repair and Proper Adjustment. 1. Equipment shall be maintained in a state of repair and condition that meets the requirements specified under subsections (1) and (2)of this Rule. Advised to have serviced. NO TCS FOOD SHALL BE STORED AT PREP TOP UNTIL SERVICED.
Adequate ventilation and lighting; designated areas used — Inspector Note: Observed employee cell phones stored on prep top table and prep top cooler. C/A:511-6-1.07(4)(b) - Designated Areas for Employee Activity, located to prevent contamination of food, equipment, utensils, linens, & single service articles (C) (b) Designated Areas for Employee Activity. 1. Areas designated for employees to eat, drink, use tobacco products and electronic devices shall be located so that food, equipment, linens, and single-service and single-use articles are protected from contamination. COS: Cell phones were moved away from food for sale and prep top and tables were sanitized.
Food separated and protected — Inspector Note: Observed eggs stored directly next to raw cut chicken, raw cut chicken stored directly on top of raw beef, raw beef stored directly next to cut lettuce in walk in cooler. Observed raw turkey stored directly on top of cooked cut beef in prep top cooler. COS: Raw chicken was moved to bottom shelf of walk in cooler. Raw eggs were stored on bottom shelf across from raw chicken. Cut lettuce was discarded by PIC. Raw beef was moved to shelf above raw chicken. Except during preparation, cooking, or cooling, or when time is used as the public health control, time/temperature control for safety food shall be maintained at 41°F (5°C) or below or 135°F (57°C) or above, except that roasts cooked to a temperature and for a time specified in subsection (5)(a)2 of this Rule and reheated using the same temperature and time conditions as cooking may be held at a temperature of 130°F (54°C) or above.
