In-use utensils: properly stored — Inspector Note: Observed improper storage for in-use utensils: Rice scoops stored in room temperature water; Scoop stored in Cole slaw container with the handle touching the food; Scoop stored in sugar bin with handle touching the food; ice scoop stored with handle touching the ice at the front counter. Corrected on site - rice scoops stored in clean container, sugar and Cole slaw given new scoops stored in the food with handle above the top of the food; ice scoop relocated to clean surface. 511-6-1.04(4)(k) - In-Use Utensils, Between-Use Storage (C) (k)Storage of In-Use Utensils. During pauses in food preparation or dispensing, food preparation and dispensing utensils shall be stored: 1.Except as specified under paragraph 2 of this subsection, in the food with their handles above the top of the food and the container; 2.In food that is not time/temperature control for safety food with their handles above the top of the food within containers or equipment that can be closed, such as bins of sugar, flour, or cinnamon; 3.On a clean portion of the food preparation table or cooking equipment only if the in-use utensil and the food-contact surface of the food preparation table or cooking equipment are cleaned and sanitized at a frequency specified under DPH Rule 511-6-1-.05(7)(b) and (8)(a); 4.In running water of sufficient velocity to flush particulates to the drain, if used with moist food such as ice cream or mashed potatoes; 5. Corrected on site - clean utensil container placed on shelving rack. 511-6-1.05(10)(e)1,2,4 - Equipment, Utensil, Linens, stored 6" off floor in clean, dry location (C) (e) Equipment, Utensils, Linens, and Single-Service and Single-Use Articles. 1. Except as specified in paragraph 4 of this subsection, cleaned equipment and utensils, laundered linens, and single-service and single-use articles shall be stored: (i) In a clean, dry location; (ii) Where they are not exposed to splash, dust, or other contamination; and (iii) At least 6 inches (15 centimeters) above the floor. 2. Clean equipment and utensils shall be stored as specified under paragraph 1 of this subsection and shall be stored: (i) In a self-draining position that allows air drying; and (ii) Covered or inverted. 4. Items that are kept in closed packages may be stored less than 6 inches (15 centimeters) above the floor on dollies, pallets, racks, and skids that are designed as specified under subsection (2)(hh) of this Rule.

Corrected on site - containers inverted on storage shelves. Single-service and single-use articles and cleaned and sanitized utensils shall be handled, displayed, and dispensed so that contamination of food-and lip-contact surfaces is prevented.

Corrected on site - food employee turned water supply back on when requested; advised to keep water supply on during operational hours. A handwashing sink shall be maintained so that it is accessible at all times for employee use.

Time as a public health control: procedures and records — Inspector Note: Observed cooked chicken held using time as a public health control without written procedures or proper time labeling to indicate how long the food had been out of temperature control or when it should be discarded. Corrected on site - pans of cooked chicken labeled with cook time and discard time. PIC advised that written procedures for handling cooked chicken on TPHC should be developed and kept on site. 511-6-1.04(6)(i) - Time as a Public Health Control (TPHC) (P, Pf, C) (i) Time as a Public Health Control. 1. Except as specified under paragraph 4 of this subsection, if time without temperature control is used as the public health control for a working supply of time/temperature control for safety food before cooking, or for ready-to-eat time/temperature control for safety food that is displayed or held for sale or service, written procedures shall be prepared in advance, maintained in the food service establishment, and made available to the regulatory authority upon request that specify: Pf (i) Methods of compliance with paragraphs 2(i) - (iv) or 3(i) through (v) of this subsection; and (ii) Methods of compliance with the cooling of time/temperature control for safety food that is prepared, cooked, and refrigerated before time is used as a public health control. Pf 2. Corrective action - PIC reported that he would call for repair to leaking and broken fixtures. A plumbing system shall be repaired according to law; and maintained in good repair.

Food-contact surfaces: cleaned & sanitized — Inspector Note: Observed dark spots on the interior of the ice bin at the slushie prep area. Observed brown substance with the appearance of rust on the interior baffle plate of the ice machine on the patio area. Corrective action - PIC advised to perform detailed cleaning on ice bin and ice machine. Equipment food-contact surfaces and utensils shall be clean to sight and touch.
