Equipment that is fixed because it is not easily movable shall be installed so that it is: (i) Spaced to allow access for cleaning along the sides, behind, and above the equipment; (ii) Spaced from adjoining equipment, walls, and ceilings a distance of not more than one thirty-second inch or 1 millimeter; or (iii) Sealed to adjoining equipment or walls, if the equipment is exposed to spillage or seepage.
Food and nonfood-contact surfaces cleanable, properly designed, constructed, and used — Inspector Note: Observed lowboy cooler at grill leaking onto the floor. 511-6-1.05(6)(a) - Good Repair & Proper Adjustment (C) (6) Maintenance and Operation. (a) Good Repair and Proper Adjustment. 1. Equipment shall be maintained in a state of repair and condition that meets the requirements specified under subsections (1) and (2)of this Rule. 2. Equipment components such as doors, seals, hinges, fasteners, and kick plates shall be kept intact, tight, and adjusted in accordance with manufacturer's specifications.
Nonfood-contact surfaces clean — Inspector Note: Observed accumulation in interior of container meant to hold sauce packets, in interior of cabinets, interior of reach-in cooler drawers connected to prep top cooler, and on shelving units containing single use containers. Also observed surface around drink nozzles in drive-thru window with black accumulation and cabinet paint chipping. PIC began the process of cleaning items listed above. 511-6-1.05(7)(a)2,3 - Equipment, Food/Nonfood-Contact Surfaces, and Utensils, food-contact surfaces of cooking equipment & nonfood-contact surfaces free of accumulations (C) 2. The food-contact surfaces of cooking equipment and pans shall be kept free of encrusted grease deposits and other soil accumulations. 3. Nonfood-contact surfaces of equipment shall be kept free of an accumulation of dust, dirt, food residue, and other debris.
Plumbing installed; proper backflow devices — Inspector Note: Observed evidence of walk-in freezer refrigeration unit with leakage (icicle formation) and exterior piping system in dry storage area for walk-in cooler and freezer leaking on to the floor. Also observed water leaking from faucet handle of vegetable washing sink when cut on. 511-6-1.06(2)(r) - System Maintained in Good Repair (P, C) (r) System Maintained in Good Repair. A plumbing system shall be repaired according to law; P and maintained in good repair.
Physical facilities installed, maintained, and clean — Inspector Note: Observed hole in ceiling tiles at drive-thru window, baseboards throughout the facility in disrepair, floor drains with old food debris, and water and grease accumulation on floors in main kitchen area.
Insects, rodents, and animals not present — Inspector Note: Observed door at the back of the facility with gaps. 511-6-1.07(2)(m) - Outer Openings Protected (C) (m) Outer Openings, Protected. 1. Except as specified in paragraphs 2 through 5 of this subsection, outer openings of a food service establishment shall be protected against the entry of insects and rodents by: (i) Filling or closing holes and other gaps along floors, walls, and ceilings; (ii) Closed, tight-fitting windows; and (iii) Solid, self-closing, tight-fitting doors. 2. The requirements in paragraph 1 of this subsection does not apply if a food service establishment opens into a larger structure, such as a mall, airport, or office building, or into an attached structure, such as a porch, and the outer openings from the larger or attached structure are protected against the entry of insects and rodents. 3. Exterior doors used as exits need not be self-closing if they are: (i) Solid and tight-fitting; (ii) Designated for use only when an emergency exists, by the fire protection authority that has jurisdiction over the food establishment; and (iii) Limited-use so they are not used for entrance or exit from the building for purposes other than the designated emergency exit use. 4. Except as specified in paragraphs 2 and 5 of this subsection, if the windows or doors of a food service establishment, or of a larger structure within which a food service establishment is located, are kept open for ventilation or other purposes or a temporary food service establishment is not provided with windows and doors as specified under paragraph 1 of this subsection, the openings shall be protected against the entry of insects and rodents by: (i) 16 mesh to 1 inch (16 mesh to 25.4 mm) screens; (ii) Properly designed and installed air curtains to control flying insects; or (iii) Other effective means. 5. The requirement in paragraph 4 of this subsection does not apply if flying insects and other pests are absent due to the location of the establishment, the weather, or other limiting condition.
Insects, rodents, and animals not present — Inspector Note: Observed single use cups stored blow electric fly trap in drive thru. 511-6-1.07(2)(k) - Insect Control Devices (C) (k) Insect Control Devices, Design and Installation. 1. Insect control devices that are used to electrocute or stun flying insects shall be designed to retain the insect within the device. 2. Insect control devices shall be installed so that: (i) The devices are not located over a food preparation area; and (ii) Dead insects and insect fragments are prevented from contact with exposed food; clean equipment, utensils, and linens; and unwrapped single-service and single-use articles.
Food-contact surfaces: cleaned & sanitized — Inspector Note: Observed interior lip of ice chute at front service drink machine with pink accumulation. 511-6-1.05(7)(b) - Food Contact Surfaces and Utensils - Cleaning Frequency (P, C) (b) Equipment Food-Contact Surfaces and Utensils.
Sewage and waste water properly disposed — Inspector Note: Observed backflow coming from the floor drain beneath the vegetable sink. PIC corrected on site by removing drain cover that was filled with a black residue causing the wastewater to backflow. PIC prevented the store from having to voluntarily close due to the imminent health hazard of sewage back up. Also observe the wastewater pipes in the three compartment sink leaking. There is also a backflow if you release a large volume of water in the three compartment sink. PIC will contact maintenance and have the plumbing issue repaired by 01/23/26. PIC will email a copy of the completed work order to [REDACTED EMAIL] by 1/23/2026. 511-6-1.06(4)(c) - Backflow Prevention (P) (c) Backflow Prevention. 1. Except as specified in paragraphs 2, 3, and 4 of this subsection, a direct connection may not exist between the sewage system and a drain originating from equipment in which food, portable equipment, or utensils are placed. P 2. The requirement in paragraph 1 of this subsection does not apply to floor drains that originate in refrigerated spaces that are constructed as an integral part of the building. 3. If allowed by law, a warewashing machine may have a direct connection between its waste outlet and a floor drain when the machine is located within 5 feet (1.5 m) of a trapped floor drain and the machine outlet is connected to the inlet side of a properly vented floor drain trap. 4. If allowed by law, a warewashing or culinary sink may have a direct connection.
Proper hot holding temperatures — Inspector Note: Observed grill chicken hot held at 115 degrees on the serving line. PIC discarded the grilled chicken. 511-6-1.04(6)(f) - Time/Temperature Control for Safety; Hot Holding (P) (f) Time/Temperature Control for Safety Food, Hot and Cold Holding. Except during preparation, cooking, or cooling, or when time is used as the public health control, time/temperature control for safety food shall be maintained at 41°F (5°C) or below or 135°F (57°C) or above, except that roasts cooked to a temperature and for a time specified in subsection (5)(a)2 of this Rule and reheated using the same temperature and time conditions as cooking may be held at a temperature of 130°F (54°C) or above.
