Nonfood-contact surfaces of equipment that are exposed to splash, spillage, or other food soiling or that require frequent cleaning shall be constructed of a corrosion-resistant, nonabsorbent, and smooth material.
Warewashing facilities: installed, maintained, used; test strips — Inspector Note: Observed the location using chlorine test strips that expired in 2019. PIC corrected on site. 511-6-1.05(3)(h),(i),(j) - Temperature Measuring Device, Manual Warewashing; Sanitizing Solutions, Testing Device (Pf) (h) Temperature Measuring Devices, Manual and Mechanical Warewashing. 1. In manual warewashing operations, a temperature measuring device shall be provided and readily accessible for frequently measuring the washing and sanitizing temperatures. Pf 2. In hot water mechanical warewashing operations, an irreversible registering temperature indicator shall be provided and readily accessible for measuring the utensil surface temperature. Pf (i) Sanitizing Solutions, Testing Devices. A test kit or other device that accurately measures the concentration in mg/L of sanitizing solutions shall be provided. Pf j) Cleaning Agents and Sanitizers. 1. Physical facilities installed, maintained, and clean — Inspector Note: Observed build up on ceiling tile above the preparation top cooler. Rust observed on ceiling tile above the dishwasher. 511-6-1.07(5)(a),(b) - Good Repair, physical facilities maintained; Cleaning, Frequency & Restrictions, cleaned often enough to keep them clean (C) (5) Maintenance and Operation. (a) Good Repair. All physical facilities shall be maintained in good repair. (b) Cleaning, Frequency and Restrictions. 1. The physical facilities shall be cleaned as often as necessary to keep them clean and by methods that prevent contamination of food products. 2. Except for cleaning that is necessary due to a spill or other accident, cleaning shall be done during periods when the least amount of food is exposed, such as after closing. 3. If present, playground equipment and associated areas shall be maintained in a clean and sanitary condition. In addition, a cleaning and sanitizing plan along with cleaning and sanitizing records for playground equipment and associated areas shall be maintained within the food service establishment for review upon request by the Health Authority. Further, such cleaning and sanitizing plan for employees to follow in the event of encountering vomitus or fecal matter shall be included and submitted at the time of permit application as specified in DPH Rule 511-6-1-.02(1)(c). Adequate ventilation and lighting; designated areas used — Inspector Note: Observed vents rusted and contained build up throughout the kitchen. PIC will have the vents treated and cleaned by 05/12/26. 511-6-1.07(5)(d) - Cleaning Ventilation System, Nuisance & Discharge Prohibition, cleaned in way not to cause contamination or create a public health hazard (C) (d) Cleaning Ventilation Systems, Nuisance and Discharge Prohibition. Intake and exhaust air ducts shall be cleaned and filters changed so they are not a source of contamination by dust, dirt, and other materials. If vented to the outside, ventilation systems may not create a public health hazard or nuisance or unlawful discharge.
Proper eating, tasting, drinking, or tobacco use — Inspector Note: Observed several employees drink cups without a straw and a lid stored in the food prep area on prep top coolers, food areas, and on the preparation table. All cups should be single use with a straw & lid and stored in a designated area to prevent contamination. 511-6-1.03(5)(k)1&2 - Eating, Drinking, or Using Tobacco (C) (k) Hygienic Practices. 1. Employees shall not use any form of tobacco products, or electronic devices that simulate tobacco smoking, while engaged in food preparation or service, nor while in areas used for equipment or utensil washing and storage, food preparation or food storage. Employees shall only use tobacco products or electronic devices that simulate tobacco smoking in approved designated areas. 2. Employees shall consume food only in approved designated areas separate from food preparation and serving areas, equipment or utensil areas and food storage areas. However, drinking from a single service beverage cup with a secure lid and straw that is handled to prevent contamination of the employee’s hands, the container, exposed food, clean equipment, utensils and linens, unwrapped single-service and single-use articles will be allowed.
Food-contact surfaces: cleaned & sanitized — Inspector Note: Observed dishes not being washed properly at the three compartment sink. Employee stated that the dishes area scrubbed, washed, and rinsed and then placed on the shelf to air dry. Advised PIC to make sure to wash the dishes properly by washing, rinsing, and sanitizing them properly. 511-6-1.05(6)(n) - Manual and Mechanical Warewashing Equipment, Chemical Sanitization-Temperature, pH, Concentration, Hardness (P,Pf) (n) Manual and Mechanical Warewashing Equipment, Chemical Sanitization - Temperature, pH, Concentration, and Hardness. A chemical sanitizer used in a sanitizing solution for a manual or mechanical operation at contact times specified under subsection (8)(b)3 of this Rule shall meet the requirements specified in DPH Rule 511-6-1-.07(6)(g), shall be used in accordance with the Environmental Protection Agency (EPA)-registered label use instructions P, and shall be used as follows: 1. A quaternary ammonium compound solution shall have a minimum temperature of 75ºF (24ºC), P have a concentration as specified in DPH Rule 511-6-1-.07(6)(g) and as indicated by the manufacturer’s use directions included in the labeling, P and be used only in water with 500 ppm hardness or less or in water having a hardness no greater than specified by the EPA-registered label use instructions; P 4. If another solution of a chemical specified under paragraphs 1 through 3 of this subsection is used, the permit holder shall demonstrate to the Health Authority that the solution achieves sanitization and the use of the solution shall be approved; P 5. If a chemical sanitizer other than chlorine, iodine, or a quaternary ammonium compound is used, it shall be applied in accordance with the EPA-registered label use instructions ;P and 6. If a chemical sanitizer is generated by a device located on-site at the food service establishment, it shall be used as specified in 1-5 of this subsection and shall be produced by a device that: (i) complies with law as specified in sections 2(q)(1) and 12 of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), P (ii) complies with 40 CFR 152.500 Requirement for Devices and 40 CFR 156.10 Labeling Requirements, P (iii) displays the EPA device manufacturing facility registration number on the device, Pf and (iv) is operated and maintained in accordance with manufacturer’s instructions. Pf. 7. On-site chemical sanitizer generating equipment with active ingredients, such as copper, must be registered as pesticides. The active ingredient may be part of the equipment or separately added.
Proper date marking and disposition — Inspector Note: Observed several TCS foods (salsa cocktail, chipotle, salsa verde, and another salsa exceeded the expiration date on the container. Salsa cocktail expired (5/2/26), Chipotle (4/26/26), salsa verde (5/10/26), and other salsa expired on 5/2/26. All sauces exceeding the expiration date was discarded. 511-6-1.04(6)(h) - Ready-To-Eat Time/Temperature Control for Safety Food, Disposition (P) (h) Ready-to-Eat, Time/Temperature Control for Safety Food, Disposition. 1. A food that requires datemarking shall be discarded if it: (i) Exceeds 7 days, not including the time that the product is frozen; P (ii) Is in a container or package that does not bear a date or day; P or (iii) Is inappropriately marked with a date or day that exceeds 7 days . P 2. Refrigerated, ready-to-eat, time / temperature control for safety food prepared in a food service establishment and dispensed through a vending machine with an automatic shutoff control shall be discarded if it exceeds 7 days. Food and nonfood-contact surfaces cleanable, properly designed, constructed, and used — Inspector Note: Observed several prep tables (bottom) with rust on them. Please clean and seal the tables. Also, observed rust on the inside of the reach in cooler/prep unit on the front-end (server area). Observed the walk in cooler door and food storage shelves with rust on them. Please clean, find a chemical to remove the rust and/or paint with an approved food grade paint.
Hot and cold water available; adequate pressure — Inspector Note: Observed the hot water pressure at the handwashing sink on the hot line at a very low pressure. Please repair so that the water pressure is restored.
Physical facilities installed, maintained, and clean — Inspector Note: Observed the ceiling of the walk in cooler leaking in several area. All food items must be removed from under the leak or by the leak. The walk in cooler ceiling must be repaired within 15 days (by 11/14/25). Please send a completed work order to [REDACTED EMAIL] by 11/14/25 showing what was wrong and the repairs that were made. Also, observed a heavy presence of ice build up in the walk in freezer. All the ice must be cleaned and make sure that employees are closing the door properly.
Adequate ventilation and lighting; designated areas used — Inspector Note: Observed a light shield missing over the light bulbs on the hot line above the prep top cooler. All lights must have a shield to protect the bulbs. 511-6-1.07(2)(i) - Light Bulbs, Protective Shielding (C) (i) Light Bulbs, Protective Shielding. 1. Except as specified in paragraph 2 of this subsection, light bulbs shall be shielded, coated, or otherwise shatter-resistant in areas where there is exposed food; clean equipment, utensils, and linens; or unwrapped single-service and single-use articles. 2. Shielded, coated, or otherwise shatter-resistant bulbs need not be used in areas used only for storing food in unopened packages, if: (i) The integrity of the packages cannot be affected by broken glass falling onto them; and (ii) The packages are capable of being cleaned of debris from broken bulbs before the packages are opened. 3. An infrared or other heat lamp shall be protected against breakage by a shield surrounding and extending beyond the bulb so that only the face of the bulb is exposed.
Adequate ventilation and lighting; designated areas used — Inspector Note: Observed an employees cup stored on the prep top table in the dishwashing area. The cup was removed (COS). Employees items must be stored in a designated area. Also, observed cover and a pillow in the outside storage area. The storage area have single use items, containers of oil, old dishes, and other items. Staff should not sleep in the storage area. The items must be removed. 511-6-1.07(4)(b) - Designated Areas for Employee Activity, located to prevent contamination of food, equipment, utensils, linens, & single service articles (C) (b) Designated Areas for Employee Activity. 1. Areas designated for employees to eat, drink, use tobacco products and electronic devices shall be located so that food, equipment, linens, and single-service and single-use articles are protected from contamination. 2. Lockers or other suitable facilities shall be located in a designated room or area where contamination of food, equipment, utensils, linens and single-service and single-use articles cannot occur.
Food-contact surfaces: cleaned & sanitized — Inspector Note: Observed the can opener with build up and meal shavings underneath the blade. The can opener was removed for cleaning (COS). Observed the container for the ice scoop with water and a black and brown build up. The container was removed for cleaning (COS). 511-6-1.05(7)(a)1 - Equipment, Food-Contact Surfaces,& Utensils (Pf) (7) Cleaning of Equipment and Utensils. (a) Equipment, Food-Contact Surfaces, and Utensils. 1. Equipment food-contact surfaces and utensils shall be clean to sight and touch. Pf.
Proper cold holding temperatures — Inspector Note: Observed (2) pans of cooked taco meat being stored in the outside storage area on the shelf at temperatures above 41F degrees. The taco meat was discarded (COS).
Proper hot holding temperatures — Inspector Note: Observed potentially hazardous food not held at 135 degrees Fahrenheit or above in a steam well that was not working. Also, observed food in the warmer cabinet not at the proper temperature.
