Manager disposed of items. 511-6-1.05(1)(a) - Materials, General Requirements (P, C) (1) Materials. (a) General Requirements. Utensils and food-contact surfaces of equipment shall be made of materials that do not allow the migration of deleterious substances or impart colors, odors, or tastes to food and under normal use conditions, and shall be: P safe P, durable, corrosion-resistant, and nonabsorbent. In addition, materials shall be sufficient in weight and thickness to withstand repeated warewashing and shall be finished to have a smooth, easily cleanable surface. Materials shall be resistant to pitting, chipping, crazing, scratching, scoring, distortion and decomposition.
Food and nonfood-contact surfaces cleanable, properly designed, constructed, and used — Inspector Note: Observed strong gas odor coming from grill area. 511-6-1.05(6)(a) - Good Repair & Proper Adjustment (C) (6) Maintenance and Operation. (a) Good Repair and Proper Adjustment.
Nonfood-contact surfaces clean — Inspector Note: Observed excessive water accumulation at bottom of reach-in cooler. Manager began the process of cleaning the cooler. 511-6-1.05(7)(a)2,3 - Equipment, Food/Nonfood-Contact Surfaces, and Utensils, food-contact surfaces of cooking equipment & nonfood-contact surfaces free of accumulations (C) 2. The food-contact surfaces of cooking equipment and pans shall be kept free of encrusted grease deposits and other soil accumulations. 3. Nonfood-contact surfaces of equipment shall be kept free of an accumulation of dust, dirt, food residue, and other debris.
Garbage/refuse properly disposed; facilities maintained — Inspector Note: Observed drain plug missing, trash accumulation around outside dumpster and outside dumpster lid in disrepair. 511-6-1.06(5)(o),(p) - Using Drain Plugs; Maintaining Refuse Areas (C) (o) Using Drain Plugs. Drains in receptacles and waste handling units for refuse, recyclables, and returnables shall have drain plugs in place. (p) Maintaining Refuse Areas and Enclosures. A storage area and enclosure for refuse, recyclables, or returnables shall be maintained free of unnecessary items and clean.
Physical facilities installed, maintained, and clean — Inspector Note: Observed excessive water accumulation in bar area and at the back of the facility near the dish washing area. Also observed multiple cracked tiles at the bar and floors in main kitchen in need of resealing. 511-6-1.07(5)(a),(b) - Good Repair, physical facilities maintained; Cleaning, Frequency & Restrictions, cleaned often enough to keep them clean (C) (5) Maintenance and Operation. (a) Good Repair. All physical facilities shall be maintained in good repair. (b) Cleaning, Frequency and Restrictions. 1. The physical facilities shall be cleaned as often as necessary to keep them clean and by methods that prevent contamination of food products. 2. Except for cleaning that is necessary due to a spill or other accident, cleaning shall be done during periods when the least amount of food is exposed, such as after closing. 3. If present, playground equipment and associated areas shall be maintained in a clean and sanitary condition. In addition, a cleaning and sanitizing plan along with cleaning and sanitizing records for playground equipment and associated areas shall be maintained within the food service establishment for review upon request by the Health Authority. Further, such cleaning and sanitizing plan for employees to follow in the event of encountering vomitus or fecal matter shall be included and submitted at the time of permit application as specified in DPH Rule 511-6-1-.02(1)(c). Adequate ventilation and lighting; designated areas used — Inspector Note: Observed strong odor at drain in bar area and strong gas odor coming from grill area in main kitchen. 511-6-1.07(3)(g) - Mechanical Ventilation, sufficient capacity to prevent buildup of heat, steam, smoke, fumes & odors (C) (g) Mechanical Ventilation. If necessary to keep rooms free of excessive heat, steam, condensation, vapors, obnoxious odors, smoke, and fumes, mechanical ventilation of sufficient capacity shall be provided.
Insects, rodents, and animals not present — Inspector Note: Observed multiple sticky fly traps with dead flies in between the ice machines, prep table, and 3-compartment sink at the back of the main kitchen. 511-6-1.07(2)(k) - Insect Control Devices (C) (k) Insect Control Devices, Design and Installation. 1. Insect control devices that are used to electrocute or stun flying insects shall be designed to retain the insect within the device. 2. Insect control devices shall be installed so that: (i) The devices are not located over a food preparation area; and (ii) Dead insects and insect fragments are prevented from contact with exposed food; clean equipment, utensils, and linens; and unwrapped single-service and single-use articles.
Food separated and protected — Inspector Note: Observed raw beef patty being stored above RTE food items and boxes of raw seafood stored without proper horizontal space between raw chicken. Manager moved beef patty and began the process of moving boxes of seafood. 511-6-1.04(4)(c)1(i)(ii)(iii)(v)(vi)(vii)(viii) - Packaged & Unpackaged Food Separation, Packaging, and Segregation (P, C) (c) Packaged and Unpackaged Food - Separation, Packaging, and Segregation. 1. Food shall be protected from cross contamination by: (i) Except as specified in paragraph (i)(IV) of this subsection, separating raw animal foods during storage, preparation, holding, and display from: (I) Raw ready-to-eat food including other raw animal food such as fish for sushi or molluscan shellfish, or other raw ready-to-eat food such as fruits and vegetables, P and (II) Cooked ready-to-eat food; and P (III) Fruits and vegetables before they are washed; P (IV) Frozen, commercially processed and packaged raw animal food may be stored or displayed with or above frozen, commercially processed and packaged, ready-to-eat food. (ii) Except when combined as ingredients, separating types of raw animal foods from each other such as beef, fish, lamb, pork, and poultry during storage, preparation, holding, and display by: (I) Using separate equipment for each type, P or (II) Arranging each type of food in equipment so that cross contamination of one type with another is prevented, P and (III) Preparing each type of food at different times or in separate areas; P (iii) Cleaning and sanitizing equipment and utensils; (v) Cleaning hermetically sealed containers of food of visible soil before opening; (vi) Protecting food containers that are received packaged together in a case or overwrap from cuts when the case or overwrap is opened; (vii) Storing damaged, spoiled, or recalled food being held in the food service establishment separate from food, equipment, utensils, linens and single-service and single-use articles; or (viii) Separating fruits and vegetables, before they are washed from ready-to-eat food.
Food-contact surfaces: cleaned & sanitized — Inspector Note: Observed food and sauce accumulation on dishes stored under prep-top cooler. Manager removed items to be properly cleaned and sanitized. 511-6-1.05(7)(a)1 - Equipment, Food-Contact Surfaces,& Utensils (Pf) (7) Cleaning of Equipment and Utensils. Utensils, equipment and linens: properly stored, dried, handled — Inspector Note: Observed plates stored underneath the prep top table not inverted. PIC will cover the top plates with foil or invert plates and bowls in order to prevent food debris from contaminating the plates below.
Food and nonfood-contact surfaces cleanable, properly designed, constructed, and used — Inspector Note: Observed the reach in cooler making a strange noise. PIC will have the cooler repaired. Also observed the lid in bad repair used to cover the rice bin.
Food-contact surfaces: cleaned & sanitized — Inspector Note: Observed build up on the soda spouts in the bar. PIC corrected on site by washing, rinsing, and sanitizing soda gun and spouts in the bar area.
Proper cold holding temperatures — Inspector Note: Observed TCS foods (Raw chicken, Guacamole, sour cream, mozzarella cheese, raw shrimp, and Ribeye steak being held at temperatures exceeding 41F. Chicken and Ribeye was placed in the reach in cooler 60 minutes ago. PIC advised to place ice on tcs foods including raw chicken, shrimp, cheese, steak, lettuce, guacamole and ribeye in the freezer until the temperature reaches 41 degrees or below. PIC will also have the low boy repaired due to the temperature being observed above 41 degrees f. 511-6-1.04(6)(f) - Time/Temperature Control for Safety; Cold Holding (P) (f) Time/Temperature Control for Safety Food, Hot and Cold Holding. Except during preparation, cooking, or cooling, or when time is used as the public health control, time/temperature control for safety food shall be maintained at 41°F (5°C) or below or 135°F (57°C) or above, except that roasts cooked to a temperature and for a time specified in subsection (5)(a)2 of this Rule and reheated using the same temperature and time conditions as cooking may be held at a temperature of 130°F (54°C) or above.
