Except as specified in paragraphs 2 and 3 of this subsection, food shall be protected from contamination by storing the food: (i) In a clean, dry location; (ii) Where it is not exposed to splash, dust, or other contamination; and (iii) At least 6 inches (15 cm) above the floor. 2. Food in packages and working containers may be stored less than 6 inches (15 cm) above the floor on case lot handling equipment if the equipment can be moved by hand or by conveniently available apparatuses such as hand trucks and forklifts. 3. Pressurized beverage containers, cased food in waterproof containers such as bottles or cans, and milk containers in plastic crates may be stored on a floor that is clean and not exposed to floor moisture.
Personal cleanliness — Inspector Note: Observed front of house employe packaging and handling food orders without proper hair restraints that presented a risk of contaminating exposed food. Observed a back of house employee without complete hair restraint. 511-6-1.03(5)(j) - Hair Restraints (C) (i) Hair Restraints. 1. Employees preparing or handling food shall use effective and clean, disposable or easily cleanable nets or other hair restraints approved by the Health Authority, worn properly to restrain loose hair including beards and mustaches longer than one half inch. 2. This does not apply to employees such as counter staff who only serve beverages and wrapped or packaged foods, hostesses, and wait staff if they present a minimal risk of contaminating exposed food, clean utensils and linens and unwrapped single-service and single-use articles.
Personal cleanliness — Inspector Note: Observed front of house employees wearing apple watched and bracelets. 511-6-1.03(5)(g) - Jewelry (C) (g) Jewelry. Except for a plain ring such as a wedding band food employees may not wear jewelry including medical information jewelry on their arms and hands while preparing food.
Nonfood-contact surfaces clean — Inspector Note: Observed food debris on the shelves and floor of the thawing cabinet cooler. Observed food debris on the bottom of the reach in cooler by the fry station. Observed food debris on the bottom the reach in cooler under the salad prep area. 511-6-1.04(4)(q) - Food Storage (C) (q) Food Storage. 1. Plumbing installed; proper backflow devices — Inspector Note: Observed condensation leak in the walk in cooler. An electronic monitor displayed a message on the cooler fan/condensing unit that stated "no good valve". PIC advised that someone had been called to repair the cooler leak. PIC was advised to email a repair invoice for the condensation leak to [REDACTED EMAIL] and [REDACTED EMAIL]. 511-6-1.06(2)(r) - System Maintained in Good Repair (P, C) (r) System Maintained in Good Repair. A plumbing system shall be repaired according to law; P and maintained in good repair.
Physical facilities installed, maintained, and clean — Inspector Note: Observed sides and corners of the floor drain clogged with build up by the drive through ice machine where the drainpipe from the ice machine dispenses wastewater. The PIC was advised to clear the build up and place the drainpipe in the center of the floor drain. 511-6-1.07(5)(a),(b) - Good Repair, physical facilities maintained; Cleaning, Frequency & Restrictions, cleaned often enough to keep them clean (C) (5) Maintenance and Operation. (a) Good Repair. All physical facilities shall be maintained in good repair. (b) Cleaning, Frequency and Restrictions. 1. The physical facilities shall be cleaned as often as necessary to keep them clean and by methods that prevent contamination of food products. 2. Except for cleaning that is necessary due to a spill or other accident, cleaning shall be done during periods when the least amount of food is exposed, such as after closing. 3. If present, playground equipment and associated areas shall be maintained in a clean and sanitary condition. In addition, a cleaning and sanitizing plan along with cleaning and sanitizing records for playground equipment and associated areas shall be maintained within the food service establishment for review upon request by the Health Authority. Further, such cleaning and sanitizing plan for employees to follow in the event of encountering vomitus or fecal matter shall be included and submitted at the time of permit application as specified in DPH Rule 511-6-1-.02(1)(c). Proper eating, tasting, drinking, or tobacco use — Inspector Note: Observed employee beverages stored in tumblers and reusable water bottles. Observed employee beverages stored directly on the side on ice machine in the main kitchen next to the ice paddle and clean dish rack by the walk in cooler. Observed an opened personal tumbler mug with no lid covering. Employee food stored above customer food in the walk in cooler. Observed employee food (plums and cherries) stored below leaking condensation in the reach in cooler and in an unlabeled pan. 511-6-1.03(5)(k)1&2 - Eating, Drinking, or Using Tobacco (C) (k) Hygienic Practices. 1. Employees shall not use any form of tobacco products, or electronic devices that simulate tobacco smoking, while engaged in food preparation or service, nor while in areas used for equipment or utensil washing and storage, food preparation or food storage. Employees shall only use tobacco products or electronic devices that simulate tobacco smoking in approved designated areas. 2. Employees shall consume food only in approved designated areas separate from food preparation and serving areas, equipment or utensil areas and food storage areas. However, drinking from a single service beverage cup with a secure lid and straw that is handled to prevent contamination of the employee’s hands, the container, exposed food, clean equipment, utensils and linens, unwrapped single-service and single-use articles will be allowed.
Food-contact surfaces: cleaned & sanitized — Inspector Note: Observed quat chemical sanitizer solution in the 3 compartment sink exceeded maximum concentration (800ppm). PIC corrected on site. New concentration was within minimum and maximum requirement according to the manufacturer's requirement. 511-6-1.05(6)(n) - Manual and Mechanical Warewashing Equipment, Chemical Sanitization-Temperature, pH, Concentration, Hardness (P,Pf) (n) Manual and Mechanical Warewashing Equipment, Chemical Sanitization - Temperature, pH, Concentration, and Hardness. A chemical sanitizer used in a sanitizing solution for a manual or mechanical operation at contact times specified under subsection (8)(b)3 of this Rule shall meet the requirements specified in DPH Rule 511-6-1-.07(6)(g), shall be used in accordance with the Environmental Protection Agency (EPA)-registered label use instructions P, and shall be used as follows: 1. A quaternary ammonium compound solution shall have a minimum temperature of 75ºF (24ºC), P have a concentration as specified in DPH Rule 511-6-1-.07(6)(g) and as indicated by the manufacturer’s use directions included in the labeling, P and be used only in water with 500 ppm hardness or less or in water having a hardness no greater than specified by the EPA-registered label use instructions; P 4. If another solution of a chemical specified under paragraphs 1 through 3 of this subsection is used, the permit holder shall demonstrate to the Health Authority that the solution achieves sanitization and the use of the solution shall be approved; P 5. If a chemical sanitizer other than chlorine, iodine, or a quaternary ammonium compound is used, it shall be applied in accordance with the EPA-registered label use instructions ;P and 6. If a chemical sanitizer is generated by a device located on-site at the food service establishment, it shall be used as specified in 1-5 of this subsection and shall be produced by a device that: (i) complies with law as specified in sections 2(q)(1) and 12 of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), P (ii) complies with 40 CFR 152.500 Requirement for Devices and 40 CFR 156.10 Labeling Requirements, P (iii) displays the EPA device manufacturing facility registration number on the device, Pf and (iv) is operated and maintained in accordance with manufacturer’s instructions. Pf. 7. On-site chemical sanitizer generating equipment with active ingredients, such as copper, must be registered as pesticides. The active ingredient may be part of the equipment or separately added.
Food-contact surfaces: cleaned & sanitized — Inspector Note: Observed tongs and spatula used to transport grilled filets stored in between and underneath the grease catch pan under the grill. PIC advised that the utensils are cleaned every 4 hours and the grill and catch pan area are only cleaned once a day. PIC was advised that both utensils and surfaces that contact utensils must be cleaned every 4 hours. Food contact surfaces and utensils must be stored in a way to protect from splash, dust, and potential contamination. Observed tongs contacting the kitchen wall by the fry fryers. Observed reusable cutting gloves above the vegetable prep sinks and 3 compartment sink. PIC advised that the gloves are hand washed but not sanitized. The gloves were observed to have discoloration, indicating gloves were not properly cleaned and sanitized before use. PIC was advised to replace all cutting gloves with new ones. If employee must use cutting gloves, single use gloves must be placed over the cutting gloves and gloves must be properly washed, rinsed, and sanitized. 511-6-1.05(7)(a)1 - Equipment, Food-Contact Surfaces,& Utensils (Pf) (7) Cleaning of Equipment and Utensils. Nonfood-contact surfaces clean — Inspector Note: Observed food accumulation on the thawing cooler shelves. PIC was advised to place non-absorbent and cleanable shelf covers to prevent food accumulation from contaminating the raw chicken. Observed food debris on the bottom of the cookie station reach in cooler and salad prep reach in cooler.
