Utensils, equipment and linens: properly stored, dried, handled — Inspector Note: In use utensils (Scoop) and spatula used to remove grilled chicken were both stored on areas containing build up. The shelves contained a brown powder. The area below the grill contained old cooked food debris. The storage area must be properly cleaned and sanitized every four hours if the food contact surfaces will be stored in those areas. 511-6-1.05(10)(e)1,2,4 - Equipment, Utensil, Linens, stored 6" off floor in clean, dry location (C) (e) Equipment, Utensils, Linens, and Single-Service and Single-Use Articles. 1. Except as specified in paragraph 4 of this subsection, cleaned equipment and utensils, laundered linens, and single-service and single-use articles shall be stored: (i) In a clean, dry location; (ii) Where they are not exposed to splash, dust, or other sources of contamination; and (iii) At least 6 inches (15 centimeters) above the floor. 2. Clean equipment and utensils shall be stored as specified under paragraph 1 of this subsection and shall be stored: (i) In a self-draining position that allows air drying; and (ii) Covered or inverted. 4. Items that are kept in closed packages may be stored less than 6 inches (15 centimeters) above the floor on dollies, pallets, racks, and skids that are designed as specified under subsection (2)(hh) of this Rule.

Food and nonfood-contact surfaces cleanable, properly designed, constructed, and used — Inspector Note: Observed the lid and side panel door in bad repair on the preparation top cooler. PIC advised that he has submitted a work order. 511-6-1.05(6)(a) - Good Repair & Proper Adjustment (C) (6) Maintenance and Operation. (a) Good Repair and Proper Adjustment. 1. Equipment shall be maintained in a state of repair and condition that meets the requirements specified under subsections (1) and (2)of this Rule. 2. Equipment components such as doors, seals, hinges, fasteners, and kick plates shall be kept intact, tight, and adjusted in accordance with manufacturer's specifications. 3. Cutting or piercing parts of can openers shall be kept sharp to minimize the creation of metal fragments that can contaminate food when the container is opened.

Item 15C Good Retail Practice

Nonfood-contact surfaces clean — Inspector Note: Observed build up on shelves above the soup storage area. Also observed condensation build up in the bottom of the reach in salad cooler. Excessive condensation water build up was also observed in the thawing cabinet. The catch pans were full and dripping on the floor. According to the PIC, the catch pans are cleaned once a week. PIC was instructed to clean the catch pans daily. Build up also observed on the bottom of the reach in cooler in the drive thru area. 511-6-1.05(7)(a)2,3 - Equipment, Food/Nonfood-Contact Surfaces, and Utensils, food-contact surfaces of cooking equipment & nonfood-contact surfaces free of accumulations (C) 2. The food-contact surfaces of cooking equipment and pans shall be kept free of encrusted grease deposits and other soil accumulations. 3. Nonfood-contact surfaces of equipment shall be kept free of an accumulation of dust, dirt, food residue, and other debris.

Physical facilities installed, maintained, and clean — Inspector Note: Observed an excessive amount of white and green liquid residue along with molded food and trash debris below reach in coolers in the salad preparation area, dishwashing storage area, and below the thawing cabinets. There was an odor of mold coming from the areas that contained build up. PIC was instructed to clean and disinfect the areas immediately. PIC advised that the areas were pressure washed at night however equipment is not being moved prior to cleaning. PIC instructed to submit a plan of action to [REDACTED EMAIL] and [REDACTED EMAIL] by 8/5/2026 in regard to properly cleaning and sanitizing the kitchen/food prep area. Observed a white powder used by the pest control company on baseboards in the dishwashing area and food preparation 511-6-1.07(5)(a),(b) - Good Repair, physical facilities maintained; Cleaning, Frequency & Restrictions, cleaned often enough to keep them clean (C) (5) Maintenance and Operation. (a) Good Repair. All physical facilities shall be maintained in good repair. (b) Cleaning, Frequency and Restrictions. 1. The physical facilities shall be cleaned as often as necessary to keep them clean and by methods that prevent contamination of food products. 2. Except for cleaning that is necessary due to a spill or other accident, cleaning shall be done during periods when the least amount of food is exposed, such as after closing. 3. If present, playground equipment and associated areas shall be maintained in a clean and sanitary condition. In addition, a cleaning and sanitizing plan along with cleaning and sanitizing records for playground equipment and associated areas shall be maintained within the food service establishment for review upon request by the Health Authority. Further, such cleaning and sanitizing plan for employees to follow in the event of encountering vomitus or fecal matter shall be included and submitted at the time of permit application as specified in DPH Rule 511-6-1-.02(1)(c). Proper eating, tasting, drinking, or tobacco use — Inspector Note: Observed consumed employee water bottles, open gatorade, and thermos cups stored in designated areas in the kitchen. Single service cups with a straw and lid must be used. 511-6-1.03(5)(j)1&2 - Eating, Drinking, or Using Tobacco (C) (j) Hygienic Practices. 1. Employees shall not use tobacco in any form, or electronic devices that simulate tobacco smoking, while engaged in food preparation or service, nor while in areas used for equipment or utensil washing and storage, food preparation or food storage. Employees shall only use tobacco products or electronic devices that simulate tobacco smoking in approved designated areas. 2. Employees shall consume food only in approved designated areas separate from food preparation and serving areas, equipment or utensil areas and food storage areas. However, drinking from a single service beverage cup with a secure lid and straw that is handled to prevent contamination of the employee’s hands, the container, exposed food, clean equipment, utensils and linens, unwrapped single-service and single-use articles will be allowed.

Adequate handwashing facilities supplied & accessible — Inspector Note: Observed an employee discarding a beverage that included ice at the handwashing sink in the front of house while the inspector was washing her hands. PIC as well as the employee were both advised that the handsink can be used for handwashing only. Food-contact surfaces: cleaned & sanitized — Inspector Note: Observed quaternary ammonium (Monitor for QAC)(Serim) sanitizer in the three compartment sink did not meet the minimum requirements of 150-200 ppm while the employee was in the process of washing dishes. The sanitizer was observed at 75 ppm. PIC advised the dishmachine was out of order. PIC instructed to remake the sanitizer. 511-6-1.05(6)(n) - Manual and Mechanical Warewashing Equipment, Chemical Sanitization-Temperature, pH, Concentration, Hardness (P,Pf) (n) Manual and Mechanical Warewashing Equipment, Chemical Sanitization - Temperature, pH, Concentration, and Hardness. A chemical sanitizer used in a sanitizing solution for a manual or mechanical operation at contact times specified under subsection (8)(b)3 of this Rule shall meet the requirements specified in DPH Rule 511-6-1-.07(6)(g), shall be used in accordance with the Environmental Protection Agency (EPA)-registered label use instructions P, and shall be used as follows: 1. Toxic substances properly identified, stored, used — Inspector Note: Observed a white powdery substance on baseboards in the dishwashing and food preparation area. According to the PIC and pest control records, Ecolab uses an insecticide powder in the interior and exterior of the facility. PIC instructed that the boric acid cannot be used in the kitchen area. PIC will contact pest control and deep clean both areas. 511-6-1.07(6)(n) - Tracking Powders, Pest Control & Monitoring (P, C) (n) Tracking Powders, Pest Control and Monitoring. A tracking powder pesticide may not be used in a food service establishment. Personal cleanliness — Inspector Note: Observed team members with loose hair preparing beverages in the drive thru and at the front counter. PIC was advised that team members must have hair restraints to prevent potential contamination of food from employees. 511-6-1.03(5)(j) - Hair Restraints (C) (i) Hair Restraints. 1. Employees preparing or handling food shall use effective and clean, disposable or easily cleanable nets or other hair restraints approved by the Health Authority, worn properly to restrain loose hair including beards and mustaches longer than one half inch. 2. This does not apply to employees such as counter staff who only serve beverages and wrapped or packaged foods, hostesses, and wait staff if they present a minimal risk of contaminating exposed food, clean utensils and linens and unwrapped single-service and single-use articles.
