PIC will have the door repaired and hinges replaced by 9/1/26. Also observed a large burn hole in the wall below the dishwashing area. 511-6-1.07(5)(i) - Closing Toilet Room Doors (C) (i) Closing Toilet Room Doors. Except during cleaning and maintenance operations, toilet room doors as specified under subsection (2)(l) of this Rule shall be kept closed.
Food separated and protected — Inspector Note: Observed raw beef and raw shrimp stored next to raw chicken in the walk in cooler. Cooked pork was stored next to raw beef. Raw tilapia was stored above cooked pork.
Food-contact surfaces: cleaned & sanitized — Inspector Note: Observed an employee washing dishes improperly. The three compartment sink was not properly set up to wash, rinse, and sanitize dishes. PIC corrected on site. Sanitizer was not being used in the third compartment. The dishes were being washed and rinsed only.
Contamination prevented during food preparation, storage, display — Inspector Note: Observed peppers and onions stored next to the handsink in the kitchen area. Three containers of margarita mix were not stored six inches above the floor. Also observed a continuous leak coming from the AC unit leaking into the three compartment sink and over clean dishes stored in the three-compartment sink area. Also observed an employee using the handsink to fill water pitchers. PIC instructed to not use the handsink for refilling or filling water pitchers to prevent potential cross contamination from handwashing. 511-6-1.04(4)(q) - Food Storage (C) (q) Food Storage. 1. Except as specified in paragraphs 2 and 3 of this subsection, food shall be protected from contamination by storing the food: (i) In a clean, dry location; (ii) Where it is not exposed to splash, dust, or other contamination; and (iii) At least 6 inches (15 cm) above the floor. 2. Food in packages and working containers may be stored less than 6 inches (15 cm) above the floor on case lot handling equipment if the equipment can be moved by hand or by conveniently available apparatuses such as hand trucks and forklifts. 3. Pressurized beverage containers, cased food in waterproof containers such as bottles or cans, and milk containers in plastic crates may be stored on a floor that is clean and not exposed to floor moisture.
Posted: Permit/Inspection/Choking Poster/Handwashing — Inspector Note: Observed the inspection score was posted behind a fixture. The inspection report and current food permit must be posted within 15 feet from the front door, five to seven feet from the floor, and within one food of reading distance. 511-6-1.02(1)(d) - Displaying of the Inspection Report (C) 1. The most current inspection report shall be prominently displayed in public view at all times, within fifteen feet of the front or primary public door and between five feet and seven feet from the floor and in an area where it can be read at a distance of one foot away. 2. Food service establishments with drive-thru windows will post the current inspection report, and also have the inspection report posted so that a minimum of the top one-third of a copy of the current inspection report is visible through each window allowing customers to easily read the score, date of inspection and establishment information. 3. At food service establishments with no primary or public door, the current inspection report shall be prominently displayed at all times where the documents can be read by the public from a distance of one foot away. If requirements of this paragraph are not possible because of physical restrictions, a location will be determined as approved by the Health Authority. 4. The most current inspection report for mobile food service units and extended food service units issued by the local Health Authority having jurisdiction for its inspections shall be prominently displayed in public view during all hours of operation. Such inspection reports shall be prominently displayed at the point of service where the documents can be read by the public from a distance of one foot away. 5. A food service establishment inspection report addendum need not be displayed, but shall be made available by the food service establishment to the public upon request.
In-use utensils: properly stored — Inspector Note: Observed a wire basket skimmer stored wedged between the wall and equipment. PIC corrected on site. 511-6-1.04(4)(k) - In-Use Utensils, Between-Use Storage (C) (k)Storage of In-Use Utensils. During pauses in food preparation or dispensing, food preparation and dispensing utensils shall be stored: 1.Except as specified under paragraph 2 of this subsection, in the food with their handles above the top of the food and the container; 2.In food that is not time/temperature control for safety food with their handles above the top of the food within containers or equipment that can be closed, such as bins of sugar, flour, or cinnamon; 3.On a clean portion of the food preparation table or cooking equipment only if the in-use utensil and the food-contact surface of the food preparation table or cooking equipment are cleaned and sanitized at a frequency specified under DPH Rule 511-6-1-.05(7)(b) and (8)(a); 4.In running water of sufficient velocity to flush particulates to the drain, if used with moist food such as ice cream or mashed potatoes; 5. In a clean, protected location if the utensils, such as ice scoops, are used only with a food that is not time/temperature control for safety food; or 6. In a container of water if the water is maintained at a temperature of at least 135°F (57°C) and the container is cleaned at a frequency specified under DPH Rule 511-6-1-.05(7)(b)3(vi).
Plumbing installed; proper backflow devices — Inspector Note: Observed several leaks coming from the AC unit above the three compartment sink. PIC advised that a work order was placed to have the leak repaired. PIC will email a copy of the work order to [REDACTED EMAIL] and [REDACTED EMAIL] by 8/19/26.
Insects, rodents, and animals not present — Inspector Note: Observed live fruit flies in the bar area. Also observed a dead house fly in a bottle of liquor. PIC corrected on site by discarding the bottle of liquor. A dead cockroach was also observed in the employee restroom. 511-6-1.07(5)(k) - Controlling Pests (Pf, C) (k) Controlling Pests. The presence of insects, rodents, and other pests shall be controlled to minimize their presence on the premises by: 1. Routinely inspecting incoming shipments of food and supplies; 2. Routinely inspecting the premises for evidence of pests; 3. Using methods, if pests are found, such as trapping devices or other means of pest control as specified under subsections (6)(e), (6)(m), and (6)(n) of this Rule; Pf and 4. Eliminating harborage conditions.
Proper eating, tasting, drinking, or tobacco use — Inspector Note: Observed a box of pizza stored in the food preparation area. Also observed a consumed/open bottle of water stored next to margarine. An open can drink was stored next to food in the reach in freezer. An open bag of chips was also stored in the food preparation area. 511-6-1.03(5)(k)1&2 - Eating, Drinking, or Using Tobacco (C) (k) Hygienic Practices. 1. Employees shall not use any form of tobacco products, or electronic devices that simulate tobacco smoking, while engaged in food preparation or service, nor while in areas used for equipment or utensil washing and storage, food preparation or food storage. Employees shall only use tobacco products or electronic devices that simulate tobacco smoking in approved designated areas. 2. Employees shall consume food only in approved designated areas separate from food preparation and serving areas, equipment or utensil areas and food storage areas. However, drinking from a single service beverage cup with a secure lid and straw that is handled to prevent contamination of the employee’s hands, the container, exposed food, clean equipment, utensils and linens, unwrapped single-service and single-use articles will be allowed.
Food in good condition, safe, and unadulterated — Inspector Note: Observed a container of moldy raw chicken/milk mixture and a container of coleslaw stored in the reach in cooler. Advised PIC to discard the molded chicken and coleslaw for not being safe for consumption (COS). 511-6-1.04(1) - Safe, unadulterated and Honestly Presented (P) (1) Condition. Food shall be safe, unadulterated, and honestly presented. P
Proper date marking and disposition — Inspector Note: Observed expired foods including raw chicken nuggets (8/13), sliced pineapples (8/11), Poblano's with peppers and eggs (8/15/), and coleslaw (8/16) were stored past the disposal date. 511-6-1.04(6)(h) - Ready-To-Eat Time/Temperature Control for Safety Food, Disposition (P) (h) Ready-to-Eat, Time/Temperature Control for Safety Food, Disposition. 1. A food that requires datemarking shall be discarded if it: (i) Exceeds 7 days, not including the time that the product is frozen; P (ii) Is in a container or package that does not bear a date or day; P or (iii) Is inappropriately marked with a date or day that exceeds 7 days . P 2. Refrigerated, ready-to-eat, time / temperature control for safety food prepared in a food service establishment and dispensed through a vending machine with an automatic shutoff control shall be discarded if it exceeds 7 days. Food separated and protected — Inspector Note: Observed raw beef stored between whole corn and fresh produce. Observed raw chicken stored by sliced pineapples. Observed sliced pineapples stored directly on top of raw chicken wings. Food items should be stored according to their cooking temperatures. PIC removed items and started the proper arrangement of food items (COS). 511-6-1.04(4)(c)1(i)(ii)(iii)(v)(vi)(vii)(viii) - Packaged & Unpackaged Food Separation, Packaging, and Segregation (P, C) (c) Packaged and Unpackaged Food - Separation, Packaging, and Segregation. 1. Food shall be protected from cross contamination by: (i) Except as specified in paragraph (i)(IV) of this subsection, separating raw animal foods during storage, preparation, holding, and display from: (I) Raw ready-to-eat food including other raw animal food such as fish for sushi or molluscan shellfish, or other raw ready-to-eat food such as fruits and vegetables, P and (II) Cooked ready-to-eat food; and P (III) Fruits and vegetables before they are washed; P (IV) Frozen, commercially processed and packaged raw animal food may be stored or displayed with or above frozen, commercially processed and packaged, ready-to-eat food. Food-contact surfaces: cleaned & sanitized — Inspector Note: Observed the ice scoop holder with the scoop stored inside of it with a brown build up on the interior surface. The scoop and holder were removed for cleaning. Observed the produce cutter and can opener stored with clean dishes with old food build up. The can opener also had a build up of metal shaving.
